"Will by Indian citizen domiciled in Germany "
An Indian citizen domiciled in Germany at the time of his death has executed a will in India in respect of his immovoble and movable properties in Germany. Please inform whether, according to private international law as it prevails in Germany, it is the German law or the Indian law which would be applicable as regards (A) testamentary capacity and (B) formal validity of the will.

1. "RE: Wills"
(1) For questions of capacity, German conflicts law points to the law of the country of which the person concerned is a national, in this case to Indian law.

(2) As concerns form requirements for wills, German conflicts law invokes an array of up to five different laws. In particular, the will is valid if the form requirements of any one of the following laws are met: the law of the country of which the testator is a national, the law at the testator's domicile, or the law of the place where the will was made.
