Dear Jeroen,

I found your paper very interesting but was surprised not to see any mention of Peter Benson's discussions/theory of misfeasance/nonfeasance (which relate the concept to interference with legal rights and conferral of benefits rather than to acts or omissions) or to Professor Weinrib's later opinions on the matter (e.g. in The Idea of Private Law where he changes his mind on a duty to rescue).

Inclusion of this line of thought (and its refutation if possible) would seem to be necessary if your thesis (i.e. that a limited duty to rescue based on personal circumstances be recognized in the common law) is to be fully supported.
