Is a landlord allowed to keep part of the deposit for a property for 6 months until they receive a heating bill?? The tenancy agreements states that the monthly charge for the heating can be adjusted according to bills but it was assumed that this had to be done upon departure? Surely you can request intermediate heating bills in Germany? The agreement also states that the landlord is not entitled to withold the deposit for any reason other than damage or if the property has not been painted (neither of which apply). What is the legal situation?

There is no straightforward answer - a lot depends on the exact wording of the contract (and possibly on the contract under which the heating bill is furnished). Another important factor is whether this is a contract for residential property. If it is, any outstanding amount must carry interest.
