I am attempting to locate a German case from the Federal Constitutional Court in 1979.This case concerning pension rights to non-nationals challenged the arrangements as not subscribing to the principle that like cases should be treated alike.The court ruled that CONTRIBUTORY PENSION RIGHTS SHOULD BE SEEN AS THE PROPERTY of the contributors and therefore the state must justify occasions when pension rights are withdrawn if a person leaves the country.I would be very grateful if anyone could locate the 'reference' or 'name' of this very important case. I happen to know the judgment, and it does indeed make the point you mention. This is how it is quoted: BVerfG 20.3.1979, BVerfGE 51, 1 - whereas "BVerfG" stands for Bundesverfassungsgericht or Federal Constitutional Court, and "BVerfGE" stands for "Amtliche Sammlung der Entscheidungen des Bundesverfassungsgerichts", or Official Collection of the Decisions of the Federal Constitutional Court.
